Nemeth Law’s Raising the Bar series continues on Oct. 11 with ‘Managing workplace investigations and their role in minimizing poor behavior’

Raising the Bar, an educational series raising employer awareness of current issues in employment and labor law and offered by Detroit-based management side labor and employment law firm Nemeth Law, P.C., returns on Wednesday, October 11, to address the practice of Conducting Workplace Investigations. In this session, Nemeth Law attorneys will conduct a mock investigation and discuss how it may be used as a tool for diminishing the effects of bad behavior when properly managed.

Employers are seeing an uptick in the number of employee complaints about co-workers doing or saying offensive things, according to Terry Bonnette, a partner at Nemeth Law.

“Employers have many questions about how to look into situations where employees are reacting to each other’s vocal personal beliefs; they want to know what measures they can take without crossing the privacy line,” Bonnette said. “A thorough investigation may help in resolving the issue or be used as a valuable defense to a lawsuit, but it could also lose effectiveness if not conducted using appropriate guidelines.”

At the October 11 Raising the Bar, Nemeth Law attorneys will discuss best practices for employers in today’s charged workplace climate. Topics include:

• Pre-Investigation: What warrants an investigation, who should investigate, and how to manage the alleged victim and alleged wrong-doer in the meantime.
• Mock Investigation: How to interview the victim, the witnesses and the accused.
• Privacy, surveillance, off-duty conduct, social media and workplace searches.
• He said/She said: Making credibility determinations during a workplace investigation.
• Preventing retaliation and compliance with the EEOC’s new anti-retaliation guidelines.
• Concluding the investigation: What to include, what not to include and what to share.

Raising the Bar will be held on Wednesday, October 11, at the Management Education Center, 811 West Square Lake Road, Troy, 48098. 2016 Labor and Employment Update is focus of Nemeth Law’s Raising the Bar series on Jan. 20

Detroit, Mich.-–-Dec. 29, 2016–Raising the Bar, an educational series raising employer awareness of current issues in employment and labor law and offered by Detroit-based management side labor and employment law firm Nemeth Law, P.C., returns Jan. 20, 2016 with the annual labor and employment law update. The Jan. 20 presentation will review labor and employment law changes in 2015 and hot button compliance issues for the year ahead. Patricia Nemeth, founder of Nemeth Law, P.C., said 2015 was a milestone year.

“Over the past 12 months, the Department of Labor proposed changes to overtime regulations that will convert 4.6 million salaried employees to non-exempt employees eligible for overtime pay; the EEOC proposed new regulations that will govern employee wellness programs – ensuring their compliance with GINA and the ADA; and the Supreme Court decided cases on same sex marriage and religious accommodation” Nemeth said.

“The Court also addressed the vesting of retiree health benefits under a collective bargaining agreement,” Nemeth added. “That’s a far reaching list of changes. Up next is deciding cases on constructive discharge, class action certification, and whether public employees can be compelled to pay union dues. As 2015 ends and 2016 begins, changing labor and employment laws are definitely in the spotlight.”

Nemeth Law’s Susan Koval named to 2015 ‘Women in the Law’ class by Michigan Lawyers Weekly

Detroit, Mich. – August 26, 2015 – Nemeth Law, P.C., a Detroit-based management labor and employment law firm, is pleased to announce partner Susan D. Koval was named to the 2015 class of ‘Women in the Law’ by Michigan Lawyers’ Weekly. The legal trade publication salutes 30 high achieving women attorneys throughout the state who are committed to excellence in the practice of law, serve as an inspiring and accomplished leader in the profession and a mentor to other women, and contribute significant time and effort to volunteerism. Koval is a management-side employment litigator with more than 30 years of legal experience. After a clerkship with a federal judge in her home state of West Virginia, she moved to Michigan to practice employment law. Koval’s personal and professional development was greatly influenced by her mother Nedra Koval, who was in an orphanage as a baby, dropped out of high school and married young. She ultimately went back to school and obtained a bachelor’s degree and master’s degree in fine arts, and received a law degree from the West Virginia University College of Law, where she graduated in the class just ahead of her daughter.
