Dickinson Wright Prevails in Patent Litigation Trial on Behalf of Hitkansut LLC

TROY, Mich., March 21, 2019 – Dickinson Wright PLLC is pleased to announce that Attorneys John S. Artz, John A. Artz, and Franklin M. Smith have prevailed on behalf of Hitkansut LLC and Acceledyne Technologies, Ltd. LLC (collectively, “Hitkansut”) in a patent infringement case against Oak Ridge National Laboratory, a research laboratory sponsored by the U.S. Department of Energy. On Friday, March 15, 2019, Federal Claims Judge Charles F. Lettow released a 30-page opinion granting Hitkansut’s request for attorneys’ fees and costs.

“We are pleased with Judge Lettow’s rulings in this case in favor of our client, Hitkansut LLC,” said John S. Artz, Member and Chair of Dickinson Wright’s Intellectual Property Litigation Practice Group. “This case makes clear that while the Government may take a person’s patent, the manner in which the Government takes the patent of a small company can affect the amount of compensation owed for the taking. We are happy that we were able to provide the necessary tools in the successful pursuit of our client’s claims of patent infringement against the U.S. government.”

Hitkansut’s founder, Ms. Donna M. Walker, invented and patented a materials processing method that provides unexpected benefits including significant energy savings, accelerated material processing efficiencies, and the ability to create new materials. In an effort to commercialize this novel method, Hitkansut disclosed it to Oak Ridge National Laboratory (ORNL) under a Non-Disclosure Agreement. ORNL took Ms. Walker’s novel method, used it for its own benefit, including filing multiple patent applications and then won a prestigious industry research award. Hitkansut then filed suit against the U.S. Government in the Court of Federal Claims.

Dickinson Wright secured a favorable interpretation of the patent claims at issue and successfully defended against the Government’s challenges that the Hitkansut patent does not constitute patentable subject matter or is otherwise invalid. Over the course of a two-week trial, Dickinson Wright presented substantial evidence of ORNL’s infringement of Hitkansut’s patent, in addition to rebutting ORNL’s patent invalidity positions. On January 27, 2017, Judge Lettow issued an opinion finding that Hitkansut’s patent claims are valid, that the U.S. Government infringed all asserted claims, and provided an award of damages. The Court of Appeals for the Federal Circuit affirmed the court’s finding that Hitkansut’s patent is both valid and infringed. After preserving the court’s findings of infringement and validity on appeal, Hitkansut sought its attorneys’ fees and costs incurred in the protracted litigation against the government. After briefing and oral argument, the Court granted the vast majority of Hitkansut’s requested fees and costs.

According to Judge Lettow’s opinion, the “significant” fee award was justified after the lengthy, hard-fought case, and noted, “Hitkansut’s claim, however, was vigorously contested by the government, involved highly technical subject matter, spanned six years and proceeded through a lengthy appeal. Hitkansut also faced an opponent with vast resources whose calculus regarding settlement and the value of precedent differs from that of a private litigant.”

Attorney Daniel Quick Elected to the Council of the ABA’s Section of Litigation

Attorney Robert Joslyn Joins Dickinson Wright’s Troy Office

TROY, Mich., January 8, 2019 – Dickinson Wright PLLC is pleased to announce that Attorney Robert Joslyn has joined the firm’s Troy office as Of Counsel.

Mr. Joslyn focuses his practice on estate planning and administration. He has been a speaker before the Detroit and other estate planning councils and has lectured extensively for the University of Michigan’s Institute of Continuing Legal Education and the State Bar of Michigan. He has also lectured at the University of Michigan Law School, the Notre Dame Tax and Estate Planning Institute, and the American College of Trust and Estate Counsel. He has authored many articles and books on probate, tax, and estate planning topics, and acted as expert witness on estate, trust, and tax matters in numerous court and arbitration proceedings.

Mr. Joslyn is a Fellow (and past State Chair and Regent) of the American College of Trust and Estate Counsel and a past Academician of the International Academy of Estate and Trust Law. He is also a member of the State Bar of Michigan’s Probate and Estate Planning Section (and past Chair of its Council), the Financial and Estate Planning Council of Metropolitan Detroit Inc. (and past President), and the Financial Estate and Planning Council of Macomb. He is recognized as a leader in his field by Best Lawyers in America, Michigan Super Lawyers, and DBusiness Top Lawyers. Attorney Jessica Currie Joins Dickinson Wright’s Troy Office

TROY, Mich., January 8, 2019 – Dickinson Wright PLLC is pleased to announce that Attorney Jessica Currie has joined the firm’s Troy office as Of Counsel.

Ms. Currie focuses her practice on appeals, class actions, and commercial litigation, representing clients in state and federal courts across the country, including the United States Supreme Court. She has handled matters involving a wide range of subjects, including products liability, employment, intellectual property, constitutional law, tax, business torts, and consumer protection. She also regularly presents and publishes on issues relating to employment law, class actions, and appeals.

Ms. Currie is a National Trial College Fellow of the American Board of Trial Advocates and a Fellow of the Oakland County Bar Foundation. She is recognized as a leader in her field by Michigan Super Lawyers “Rising Stars” and was named an “Up & Coming Lawyer” by Michigan Lawyers Weekly. Six Dickinson Wright Attorneys in Southeast Michigan Elected as Members of the Firm

Frederick Dewey is a Member in the firm’s Detroit office. His practice focuses primarily on the areas of commercial and business litigation, real estate litigation, eminent domain, and probate litigation. From assisting with the resolution of pre-lawsuit disputes to representing clients in complex jury trials, Mr. Dewey has substantial experience at all stages of litigation. He is a Founding Member and on the Board of Directors of the Veterans Bar Association – Detroit Chapter and he is a member of the Defense Research Institute, the Detroit Bar Association, and the Federal Bar Association. He is recognized as a leader in his field by Michigan Super Lawyers “Rising Stars”. Mr. Dewey received his B.A. from Loyola University New Orleans and his J.D. from Wayne State University Law School.

Peter Domas is a Member in the firm’s Troy office. His practice is devoted to representing clients in the healthcare industry, and assisting them in navigating the complex statutory and regulatory environment unique to healthcare corporate, transactional, and litigation matters. He also counsels clients on the development and maintenance of effective internal compliance programs with a special focus on federal and state fraud and abuse laws, reimbursement regulations, and HIPAA. He is a member of the American Health Lawyers Association, the Michigan Association of Certified Public Accountants, and the State Bar of Michigan. Erin Johnson is a Member in the firm’s Troy office. Her practice focuses on advising entities and individuals in the acquisition, disposition, leasing, development, and financing, of office, retail, multi-family, and mixed-use projects throughout the United States. She is also experienced in a wide variety of corporate matters including entity formation, organization, and governance. She is a member of the State Bar of Michigan. Ms. Johnson received her B.F.A. from the University of Michigan and her J.D. from the University of Illinois College of Law.

Shannon Nichols is a Member in the firm’s Troy office. She has significant experience in all aspects of real estate finance, including representing national and regional lenders, mortgage bankers and loan servicers, with emphasis on capital markets, conduit and bank financing, including Fannie Mae and Freddie Mac multifamily and manufactured housing lending and working on loan modifications and workouts. She also has extensive commercial real estate and corporate experience, having represented clients in private practice and as in-house counsel for MSX International and Kmart Corporation. In the course of her work, she has represented companies in their financing, acquisition and disposition of various assets, including significant real estate assets. She has managed and negotiated hundreds of commercial leases and assisted real estate developers and investors with a variety of corporate, regulatory, and real estate matters. She received her B.A. from Alma College and her J.D. from the University of Detroit Mercy School of Law.

Matthew Snider is a Member in the firm’s Ann Arbor office. He focuses his practice on trademarks, including trademark prosecution, portfolio management, trademark infringement, and unfair competition. He also conducts trademark availability searches and provides risk assessment opinions on behalf of a wide range of clients, including a major U.S. and international retailer, a leading global IT and software company, pharmaceutical companies, and leading international automotive companies. He is a member of the State Bar of Michigan, the State Bar of North Carolina, and the International Trademark Association. Mr. Snider received his B.S. from Michigan State University and his J.D. from Michigan State University College of Law.

Suzanne Sukkar is a Member in the firm’s Ann Arbor office. Her practice focuses on business immigration including global workforce mobility, employment-based sponsorship and visa matters, immigration audit and compliance for corporate and individual clients across a vast array of industries. She developed a niche expertise in the area of E treaty trade and investor visas, consular processing, and start-up ventures. Through strategic planning and by offering creative solutions, she has assisted with the seamless transfer of numerous workers world-wide.
